Labeling Reports

The Food Allergy Labeling and Consumer Protection Act (FALCPA) of 2004 requires manufacturers to identify in “plain” language the presence of any of the 8 major food allergens.
It also requires food manufacturers to indicate the presence of allergens used in spices, flavorings, additives and colorings.

There are several omissions of this law including no minimum level of allergen required for labeling and the law remains silent on issues related to labeling of advisory statements for potential cross contamination with allergen ingredients in processing.

  • Almost 50% of consumers with food allergies have serious problems using food labels to determine foods to avoid (FDA)
  • One quarter of inspected food factories have the potential for cross-contamination with allergen ingredients (FDA)
  • Consumers are falsely assuming that one product is riskier than another by its label (FDA)
  • Most consumers do not understand that product recalls are voluntary from the mfg.
  • Advisory labeling warnings are not protecting the health of allergic consumers (FDA)
  • 47% of products recalled for hidden allergens since 1998 were NOT announced to the public (Tribune,2008)
  • A sizeable percentage of facilities do not apply any control measures in the handling and use of allergen ingredients (CFSAN)
  • Just 7% of consumer complaints have resulted in mislabeling recalls (Tribune, 2008)
  • Just 29% of mfg. actively store allergen ingredients in a quarantined area (CFSAN)
  • ELL is committed to providing allergen ingredient labeling information to assist consumers in safer food selections until legislation is enacted to provide more complete and accurate guidelines and requirements

ELL assists consumers who report an allergic reaction suffered from a suspected allergen not properly identified on the products label

  2. Communicates claims to respective food manufacturer and the FDA
  3. Submits monthly summary reports of allergic incident reports to the FDA offices

The data is compiled through manufacturer interviews and from publicly released documentation regarding their processing practices.
